    قرار مجلس الوزراء رقم (45) لسنة 2005م باللائحة التنفيذية لقانون الخدمة المدنية رقم (4) لسنة 1998 المعدل بالقانون رقم (4) لسنة 2005م
    المادة (112) الإجازة دون راتب
    1. يمنح الزوج أو الزوجة إذا رخص لأحدهما بالسفر للخارج لمدة ستة أشهر على الأقل إجازة دون راتب ويتعين على الدائرة الحكومية المختصة أن تستجيب في جميع الأحوال لطلب الزوج أو الزوجة على الإجازة وفق الإجراءات المتبعة في الإجازة الاعتيادية ويبلغ الديوان الذي يشعر وزارة المالية بذلك.
    2. على الموظف أن يقدم المستندات التي تؤيد الترخيص بالسفر للخارج ومدة بقاء زوجه في الخارج.
    المادة (114) إجازة الأمومة
    1. على الموظفة الحامل إبلاغ رئيسها المباشر عن الحمل في الشهر الخامس وعند الوضع فوراً وأن ترفق مع البلاغ تقريراً طبياً صادراً عن مشفى أو طبيب حكومي ويبلغ الديوان بذلك.
    2. لا يجوز تشغيل الموظفة في الشهر الخامس من الحمل في أيام العطلة الأسبوعية أو في غير أوقات الدوام الرسمي.
    3. تبدأ مدة إجازة الأمومة من يوم غياب الموظفة بسبب متعلق بالوضع وبناءً على التقرير الطبي المعتمد على النموذج المخصص لذلك.
    4. تحتسب من الإجازات المرضية أيام تغيب الموظفة الحامل أثناء الحمل بناءً على تقرير طبي معتمد وبسبب لا يتعلق بالوضع، وتحتسب أيام الإجازات المرضية للموظفة الحامل المتعلقة بالوضع ومتصلة به من إجازة الأمومة.
    المادة (115) إجازة رعاية المولود
    يجوز للموظفة المرضعة أن تقدم طلباً للحصول على إجازة دون راتب لمدة سنة لرعاية مولودها، ويتعين على الدائرة الحكومية أن تستجيب لهذا الطلب، وتستعمل النماذج والإجراءات المتبعة في الإجازة الاعتيادية، ويبلغ الديوان الذي يشعر وزارة المالية بذلك.

    Section (112) Leave without Pay
    1. A spouse permitted to travel abroad for a period of no less than six months shall be entitled to a leave without pay, under which condition the respective governmental agency shall agree to the request by the spouse to take the said leave in accordance with the ordinary observed procedures and shall notify the Bureau, which shall In turn notify that Ministry of Finance of that matter.
    2. The respective employee shall present necessary documentations in support of the permit given to him/her to travel stating the period of stay abroad.
    Section (114) Maternity Leave
    1. A pregnant employee shall notify her line manager of the pregnancy during the fifth month of her pregnancy, and upon delivery. Such required notification shall be accompanied by a medical report issued from a hospital or a public practitioner and shall be served to the bureau.
    2. No pregnant employee during the fifth month of her pregnancy period may be required to work on weekends or outside working hours.
    3. The maternity leave shall commence on the day on which the female employee is absent for matters pertaining to delivery in accordance with an approved medical report filled in through the special form prepared for this purpose.
    4. Absence days from work of a pregnant employee, for other reasons than delivery, shall be deduced from her sick leave balance in accordance with an approved medical report. However, absence days related to pregnancy shall be deduced from the maternity leave.
    Section (115) Newborn Child Care Leave
    Any breast-feeder may apply for an unpaid leave for one year to look after her newly born child. Such a request shall be approved by the respective governmental agency. Application for such a leave shall be applied for using the same ordinary leave forms, and a notification thereof shall be sent to the Bureau, and from the Bureau to the Ministry of Finance.
